Skill games were not part of the agreement, leaving the machines in legal limbo and putting the industry on track for a potentially dramatic shakeup when the Pennsylvania Supreme Court&#8217;s ruling takes effect later this year. The court has given lawmakers until October to determine whether the terminals should be regulated and taxed or removed from the market.<\/p>\n\n\n\n<p>That makes the next legislative session particularly important. There is now little room for lawmakers to simply leave the issue hanging, especially given the size of the market and the number of businesses that have come to depend on skill game revenue.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"the-budget-details\">The Budget Details<\/h2>\n\n\n\n<p>The biggest development from the latest budget negotiations may be what was left out. Lawmakers had discussed several ways of bringing skill games into Pennsylvania&#8217;s regulated gambling system, including licensing requirements, limits on the number of machines and taxes on gaming revenue. None made it into the final budget deal.<\/p>\n\n\n\n<p>That effectively leaves a standalone legislative solution as the key route for preserving the market beyond the court&#8217;s deadline. Pennsylvania has roughly <a href=\"https:\/\/www.pennsylvaniacasinos.com\/news\/skill-games-in-pennsylvania-back-in-the-spotlight-as-new-regulation-bill-emerges\/\">70,000 skill game machines<\/a>, according to state estimates, while the Independent Fiscal Office has projected that a regulated market could generate hundreds of millions of dollars in annual revenue.<\/p>\n\n\n\n<p>That money is one reason the debate has never been simply about whether the machines should exist. Lawmakers must also decide who should benefit from them and how heavy their taxes should be.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"september-could-become-the-decisive-month\">September Could Become the Decisive Month<\/h2>\n\n\n\n<p>Republican and Democratic lawmakers have traded blame over the lack of progress, while different proposals have called for dramatically different tax rates. Gov. Josh Shapiro has previously backed a <strong>52% tax<\/strong> on skill game revenue, broadly aligning the machines with the state&#8217;s heavily taxed casino gaming sector.<\/p>\n\n\n\n<p>Other proposals have sought lower rates that could make it easier for the existing industry to transition into a regulated system. That leaves Pennsylvania facing a familiar gambling policy question: how much regulation can be introduced without destroying the market lawmakers are trying to preserve?<\/p>\n\n\n\n<p>A solution could also bring skill games closer to the standards already applied to Pennsylvania&#8217;s casinos, sportsbooks and other legal gambling products. That could mean clearer licensing rules, taxation and responsible gambling requirements, while giving businesses a legal path to continue offering the games.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" class=\"wp-block-heading\" id=\"what-happens-if-lawmakers-do-nothing\">What Happens If Lawmakers Do Nothing?<\/h2>\n\n\n\n<p>The stakes are particularly high for bars, convenience stores, veterans&#8217; organizations and social clubs that have incorporated skill game revenue into their operations. Removing the machines could eliminate an important income stream for those businesses. Keeping them without a new framework, however, is increasingly difficult following the <a href=\"https:\/\/www.cbsnews.com\/philadelphia\/news\/pennsylvania-skill-games-ruling-supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court ruling<\/a>.<\/p>\n\n\n\n<p>The situation also allows Pennsylvania to address the consumer protection gap that has surrounded skill games for years. A regulated model could potentially require responsible gambling messaging, age controls and other safeguards that players already encounter across the state&#8217;s established casino market.<\/p>\n\n\n\n<p>An immediate priority for lawmakers is therefore no longer debating the history of skill games. It is deciding what the future of the market should look like.
